The Court: The propounder examines one witness in support of his case. The witness produced by the propounder identifies the Will which is Exhibit-A. The witness also identifies the signature of the testator, which is Exhibit-A1 and also that of the attesting witnesses which are A2, A3, A4, A5 and collectively A6. The witness states that he had seen the execution of the Will and that he had seen the testator execute the will first and thereafter, the attesting witnesses set and subscribed their signatures. The will is unregistered.

In such circumstances, the execution of the Will being proved as per Section 69 of the Indian Evidence Act, 1872, there will be an order in terms of prayer (a) of the petition.
