The Court: None appears on behalf of the petitioner nor is any accommodation prayed for in the second call. This matter has been pending since 2009. Mr. Alak Kumar Ghosh, learned advocate appears on behalf of the Corporation and submits that the writ petition for all practical purposes has become infructuous and no useful purpose would be served in keeping the same alive. He further submits that the name of the petitioner is in the records of the Corporation and an Assessee number has also been provided. However, no requisite application with prescribed fees has been prayed

by the petitioner till date. The notice impugned in this proceeding has with the passage of time come to a logical conclusion and final order has already been passed.

In view of the submission of Mr. Ghosh on behalf of the Corporation and in view of the deliberate absence of the petitioner, the Writ Petition No.139 of 2009 stands dismissed. Interim order, if any, stands vacated.

The Corporation is directed to take all expeditious steps in accordance with law.
