Heard Sri J. P. Khaitan, learned senior advocate, assisted by Sri Sanjay Bhowmik and Sri A. K. De, learned counsel for the appellant and Smt. Smita Das De, learned senior standing counsel for the respondents. 2.

On 13.02.2014, this Court passed the following order:- "List in the Monthly List of March, 2024, as prayed by learned counsel for the appellant to enable him to take instructions as to whether pursuant to the remand order, the order has been passed by the assessing officer."

Today, Sri J. P. Khaitan, learned senior advocate states on instructions that pursuant to the impugned remand order of the Tribunal, the

assessing officer has not passed any order and the limitation for passing order has also expired. Therefore, the appellant does not want to press this appeal. Learned counsel for the respondents does not oppose the aforesaid request of the appellant.
