1. Mr. Pourush Bandhyopadhyay, learned Counsel, is appearing for the plaintiffs.

2. Though the matter is listed under the heading 'Presentation of Plaint' but the learned counsel for the plaintiff submits that there is some technical defects in the plaint and it cannot be cured and as such he prays for withdrawal of the suit with liberty to file afresh. Counsel for the plaintiff also prays for refund of the Court fee.

3. Considering the submission made by the counsel for the plaintiffs, the plaintiffs are granted liberty to withdraw the suit with liberty to file afresh.

4. Accordingly, CS/29/2025 is dismissed as withdrawn. Liberty to file afresh.

5. The department is directed to refund the Court fee and the plaintiffs are granted liberty to use said Court fee, if the plaintiff files a fresh suit after withdrawal of the present suit.
