The Court: The instant writ application has been preferred challenging notice under reference No.C/Ins/IV/4100045 0810001302/ 7162012355/ 1715 dated 24th April, 2012 purporting to implement the ESI Act, 1948 issued by the appropriate Government (Govt. of West Bengal), in respect of the petitioner institution.

In course of hearing, learned counsel for the petitioner submits that the writ petition has now become infructuous in view of the affidavit filed by the petitioner on 20th May, 2025 wherein at paragraph 16 it appears that on receipt of Employer's code in favour of the Calcutta Boys' School Education Society, statutory liabilities along with penalty is being paid in accordance with law.

It is further stated that all payments upto July, 2024 including penalty on interest and delayed payments have been paid through the Calcutta Boys' School employer's code bearing No.41000450810001302 and subsequently Calcutta Boys' School Education Society Trust Code bearing No.41001155530001303. In view of the submission made and on hearing learned counsel appearing for both the parties, the writ petition (WPO/128/2013) is disposed of as infructuous.

Interim order, if any, stands vacated. Connected application, if any, also stands disposed of.
