On 23rd June, 2022, when the matter was listed none had appeared on behalf of the plaintiff and no accommodation was sought for.

Counsel for the defendant was directed to inform the next date of hearing to the advocate on record of the plaintiff. Counsel for the defendant had filed affidavit of service showing that the date of hearing was informed to the Counsel for the plaintiff. Let the affidavit of service be kept with the record.

Inspite of the service of notice regarding the date of intimation of hearing of the case, none appears on behalf of the plaintiff and no accommodation is sought for.

It reveals from the record that the plaintiff is not interested to proceed with the matter.

Hence, this Court has no other alternative but to dismiss CS/80/2021 for default. GA/1/2021 accordingly disposed of. Interim order, if any, stands vacated.
