... for the defendant The Court : Counsel for both the plaintiff and the defendant are present. The suit is for money lent and advanced together with the accrued amount of interest. The understanding which has been urged by the parties in the meantime is that the defendant would make over Rs.14 lakhs to the plaintiff

by way of a Demand Draft which is produced by learned counsel for the defendant in Court. It was further understood that the plaintiff would make payment for the cost of making the draft which is Rs.10,000/-. Rs.10,000/- in cash has in turn been handed over to counsel appearing for the defendant. In view of the above, the parties wish to settle the suit as well as the applications.

IA No.GA 2 of 2021 and IA No. GA 3 of 2021 are accordingly allowed. On the basis of exchange of the Demand Draft and the money, the suit being CS 65 of 2020 may be decreed subject to the parties realising the sum of Rs.14 lakhs and Rs.10,000/- respectively.
