The Court : -Heard learned counsel for the parties. In view of the dispute raised between the parties coming within the scope of the arbitration clause, the existence of which has not been challenged by the respondent, there is no impediment to appoint an arbitrator in the matter. Hence, AP/83/2023 is allowed, thereby appointing Mr. Siddhartha Banerjee [M.9830298922], an Advocate practising in this Court, as the sole arbitrator to resolve the dispute between the parties, subject to obtaining declaration/consent under section 12 of the Arbitration and Conciliation Act, 1996.
