The Court :- In view of the urgency pleaded on behalf of the plaintiff, the matter is treated as on the Day's list.

It is submitted on behalf of the plaintiff that the parties have settled their disputes and the plaintiff does not want to proceed further with this suit. In view of the submissions made on behalf of the plaintiff, AS/2/2023 is dismissed as infructuous. The interim order of arrest dated 15 February 2023 stands vacated.

The vessel M.V. SAN PROGRESS shall be released. The plaintiff is directed to communicate the passing of this order to all concerned authorities including inter-alia the Port Authorities, Customs Authorities and Coast Guard Authorities.

The Marshall is also directed to act in terms of this order of release.

Mr. Subhojit Ray appearing on behalf of the plaintiff undertakes to pay the Court Fees within the course of the day.

The e-mail dated 16th February, 2023 issued by the plaintiff be kept with the records.

Consequently, GA/1/2023 also stands disposed of as infructuous. AS 2 of 2023 also stands dismissed.
