...for the respondent The Court: The present petition has been filed by the petitioner under Section 11 of the Arbitration and Conciliation Act, 1996, seeking appointment of a Sole Arbitrator to adjudicate the disputes between the parties.
At the outset itself, the learned counsel for the parties agreed to the appointment of a Sole Arbitrator to adjudicate the disputes between the parties arising out of a leave and licence agreement dated 1st December, 2020.
Learned counsel for the parties have mutually suggested the name Mr. Ratul Das, Advocate, Bar Library Club, 2nd Floor (Mob: 9874655050), as the Sole Arbitrator to adjudicate the disputes between the parties. Since the parties have mutually agreed to the name of the learned Sole Arbitrator, he shall enter upon the reference after duly complying with Section 12 of the Arbitration and Conciliation Act. The learned Arbitrator shall be entitled to fix his remuneration in terms of the Fourth Schedule of the said Act. Since no affidavits have been called for, none of the allegations contained in the petition are deemed to have been admitted. All the issues pertaining to arbitrability, admissibility or maintainability or any other issues shall remain open to be decided by the learned Sole Arbitrator while adjudicating the disputes between the parties.
A copy of this order shall be communicated to the learned Sole Arbitrator to take necessary steps for constitution of the arbitral tribunal. With the aforesaid directions, the present petition stands disposed of.
