By an order dated 17th February, 2023 this Court has not granted leave under Section 12A of the Commercial Courts Act and returned the plaint back to the plaintiff.

The plaintiff has challenged the said order before the Hon'ble Supreme Court and the Hon'ble Supreme Court has upheld the order passed by this Court and directed the parties to approach before mediation. It is found from the order dated 17th February, 2023 that no leave is granted and the plaint was returned.

Accordingly, CS-COM/466/2024 (Old No. CS/27/2023) be delisted from the list of this Court as the plaint has already been returned. Consequently, GA/1/2023 be treated as withdrawn. (KRISHNA RAO, J.) Sbghosh
