The Court:-On the complaint lodged by the petitioner, Girish Park Police Station Case No.223 dated 29th November, 2023 was registered and investigated. Charge sheet has been filed against only one accused person. According to the petitioner, there are other accused persons whom the police is neither arresting nor taking any steps against them. The petitioner is dissatisfied with the manner in which the investigation has been conducted. The petitioner submits that the same is perfunctory and a mere eyewash. It has been submitted that the petitioner is getting regular threats to compromise the subject case.
Nothing is there on record to suggest that subsequent threats were brought to the knowledge of the police.
It will be open for the petitioner to lodge further complaint before the police alleging threat. It will also be open to the petitioner to approach learned Trial Court seeking further investigation.
In the event the petitioner approaches the learned Trial Court, the prayer of the petitioner shall be considered in accordance with law. The petitioner prays for transferring the investigation of the case to a third agency. The petitioner will be at liberty to make the prayer before the learned Trial Court.
The writ petition stands disposed of.
Report of the Officer-in-Charge, Girish Park Police Station signed on 1st May, 2024 be retained with the records.
