The Court : Learned counsel for both sides are present and submit that the parties have arrived at a consensus ad idem regarding an Arbitrator being appointed to resolve the disputes between the parties. The dispute raised between the parties is covered by the arbitration clause and is otherwise arbitrable.

Accordingly, AP/53/2024 is allowed, thereby appointing Mr. Om Narayan Rai, an Advocate of this Court (Mobile no. 98749 58601), as sole Arbitrator to resolve the disputes between the parties, subject to a declaration being obtained from the learned Arbitrator under section 12 of the Arbitration and Conciliation Act, 1996. The Arbitrator shall fix his remuneration in consonance with the provisions of the 1996 Act, read with Schedule IV thereof. (SABYASACHI BHATTACHARYYA, J.) s.bag
