...for the respondent Corporation The Court: The petitioner had been appointed as a Conductor at West Bengal Transport Corporation Limited (formerly known as The Calcutta Tramways Company (1978) Limited on 09.11.1998. Thereafter, he was promoted to the post of Inspector with effect from 03.09.2015 discharging his duties then onwards. Subsequent benefit of Career Advancement Scheme entitled him to a grade pay of Rs.2,900/- as Conductor and by virtue of promotion as aforesaid, he was to receive a grade pay to the extent of Rs.3,200/- as sanctioned by the management. The learned Advocate representing the petitioner submitted, despite the petitioner being promoted legally entitling him to an enhanced grade pay of Rs.3,200/-, he had been deprived of the same despite several representations addressed to the Managing Director of the aforesaid Corporation for considering re-fixation of the grade pay to the tune of

Rs.3,200/-, as conferred on other employees being promoted to the post of Inspector from Conductor being similarly circumstanced. Such denial to his prejudice, prompted the petitioner to file the instant writ petition. The learned Advocate representing the respondent Corporation submitted that the petitioner be asked to file a fresh representation before the concerned authority of the Corporation to evaluate his claim for a reasoned consideration of the same.

The petitioner is directed to file a representation before the Managing Director of the respondent Corporation incorporating the intent and context of his earlier representations delineating his claim and/or entitlement to the elevated scale of grade pay of Rs.3,200/- for the consideration of the said Corporation through a reasoned order within three weeks of passing of this order. The reasoned order of the Corporation is to be declared within two weeks hence.

The petitioner would be at liberty to initiate proceedings, if his claim, according to him, was not legitimately disbursed. (ANANYA BANDYOPADHYAY, J.) sg.
