The Court: Ms. Amrita Panja Moulik, learned counsel is appearing for the petitioner.

The petitioner has filed the present application for grant of letters of administration of the estate of the deceased Arun Kumar Chatterjee, who died on 24th November, 2016 leaving behind the petitioner being the wife and one daughter namely, Ute Anita Hilda Chatterjee. Counsel for the petitioner submits that the deceased had initially married one Gisela Martin in the year 1962 and out of the said wedlock, one daughter namely, Ute Anita Hilda Chatterjee was born. The marriage between the deceased and his first wife Gisela Martin was dissolved on 4th August, 1982. Thereafter, the testator had married to one Smt. Gaytri Basu in the year 1992 but the said marriage was also dissolved in the year 1993. There was no issue in between the deceased and the second wife. Thereafter, the deceased had married to the petitioner herein and there is no issue in

the wedlock between the deceased and the petitioner. The only legal heir namely, Ute Anita Hilda Chatterjee, has filed her affidavit of consent stating that the petitioner is the step-mother and she has no objection to grant of letters of administration with respect of the estate of the deceased to the petitioner herein. In the affidavit of consent, the legal heir has also stated that after her marriage with Mr. Peter Lynch, she is being known as Ute Lynch.

Heard the learned Counsel for the petitioner and perused the averments, affidavit of consent of the legal heir of the deceased. This Court finds that the legal heir of the deceased has categorically filed an affidavit and stating that she has no objection for grant of letters of administration to the petitioner. Accordingly, prayer (a) of the present application is granted.

The department is directed to issue letters of administration subject to furnishing the bond of Rs. 4 lakh with one surety on compliance of all formalities.

PLA/166/2021 is disposed of.
