The Court:- An accommodation has been sought for on behalf of the learned Advocate-on-record of the petitioner. It appears that the petitioner challenged a short tender for allotment of fee parking lot. The contract in question expired on 12.04.2023. The department intends to invite fresh e-tender for the year 2023-24 for the entire parking lot under the Kolkata Municipal Corporation. The proposal for inviting the fresh e-tender is pending approval before the appropriate authority. The existing party did not submit any application for extension of the contract till 13.04.2023. As it appears that the cause of action for filing the instant writ petition ceased to exist on account of expiry of the tender period on 12.04.2023, accordingly, there is no requirement of proceeding with the writ petition any further.

It will be open for the petitioner to participate in the e-tender process as and when the same is floated.

Instruction forwarded by the Chief Manager (Car Parking) and Manager, Parking Department, Kolkata Municipal Corporation signed on 13.04.2023 be retained with the records.

Writ petition stands disposed of.
