...for the respondent The Court: In the present matter there was a named Arbitrator who had started the proceedings. However, due to certain allegations made against the Arbitrator, the learned senior advocate who was the Arbitrator has decided to resign from the said arbitration by a letter dated 5th January, 2022. This is an application made by Magnum Propack Private Limited who are the respondent in the arbitration proceedings for appointment of a substituted Arbitrator in terms of Section 11 Clause 6 read with Section 15(2) of the Arbitration and Conciliation Act, 1996.

Counsel appearing on behalf of the respondent herein is also agreeable to appointment of a substituted Arbitrator.

In view of the above, Mr. Saikat Banerjee, Advocate, Mobile No.9830166896 is appointed as arbitrator. The appointment is subject to submission of declaration by the Arbitrator in terms of Section 12(1) in the form prescribed in the Sixth Schedule of the Act before the Registrar, Original Side of this Court within four weeks from today.

Let this order be conveyed to the Arbitrator by the Registrar, Original Side forthwith.

AP/31/2022 is, accordingly, disposed of.
