...for the defendant No. 2 The Court: Learned counsel appearing for the plaintiff hands up the letter dated 13th April, 2021 from the plaintiff written by the directors of the plaintiff Nos. 1 and 2 and by the heirs of third and fourth plaintiff to the lawyer of the plaintiffs instructing that the suit be withdrawn since one-time settlement has been entered into between the parties and accepted by the second defendant. It may be noted that second defendant added as a party defendant by way of amendment which would appear from the amended cause title of the plaint.

The defendant Nos. 1 and 2 are represented. Learned counsel appearing for the defendant No. 2 submits that the sum of Rs.301 lakhs has been made over to the plaintiffs and that nothing further remains in the suit. In view of the above, CS No. 31 of 2011 is dismissed as withdrawn. All interim orders are vacated. All connected applications are disposed of in terms of this order.
