The Court: IA GA-COM 1 of 2026 is an application for modification of the order of this Court dated June 10, 2025. The petitioner prays for extension of the time to deposit the arbitral sum and also modification of the quantum. Both parties agree to the modification of the quantum.

Under such circumstances, the order dated June 10, 2025 is modified to the extent that the amount to be deposited by the petitioner shall be enhanced from Rs. 4,94,000/- to Rs. 5,43,765/-. The enforcement of the award shall be stayed for a period of four weeks from date. Within such period the sum of Rs. 5,43,765/- shall be deposited by a demand draft before the learned Registrar, Original Side, Calcutta. Upon such deposit, the award shall remain unconditionally stayed till disposal of the application under Section 34 of the Arbitration and Conciliation Act, 1996. In case of

default, the stay shall stand automatically vacated without further reference to this Court and the award-holder shall be at liberty to proceed with the execution. The learned Registrar, Original Side upon acceptance of the demand draft shall encash the demand draft and deposit the amount in an interest bearing auto renewable fixed deposit, with any nationalized bank. A copy of the demand draft that is to be deposited by the award-debtor shall be supplied to the learned advocate-on-record for the award-holder to demonstrate compliance of this order.

The application is accordingly disposed of.
