...for the State The Court : The writ petition is taken up for consideration on the Original Side when it is found that some of the respondents are not either staying within the Original Side jurisdiction or their offices are not situated within the Original Side jurisdiction of this Court excepting respondent nos. 4 and 5.

As per Original Side Rules, all the respondents are required to be staying or their offices are situated within the Original Side jurisdiction.

However, on this ground, this Court finds that the writ petition ought not to be dismissed since the petitioner has approached this Court in terms of Article 226 of the Constitution of India.

The department is directed to convert this writ petition on the Original Side into a writ petition in the Appellate Side by seven days upon compliance of necessary formalities and re-number the same.

The Advocate-on-Record for the petitioner is directed to cooperate with the department in converting the present writ petition into a writ petition on the Appellate Side. After conversion of the writ petition is completed and the writ petition is renumbered, the writ petition to be included in the combined monthly list of August, 2024 under the heading "Motion".
