The Court : Ms. Dipika Sarkar, learned counsel is appearing for the plaintiff. Counsel for the plaintiff prays for withdrawal of the suit and submits that without initiation of pre-litigation mediation process, the plaintiff has filed the instant suit. She submits that she may be allowed to withdraw the suit for taking appropriate steps for initiation of pre-institution mediation process. Counsel for the plaintiff further submits that the plaintiff has deposited the Court-fee of Rs.50,000/- and she may be allowed to take back the Court-fee so as to enable the plaintiff to re-use the said Court-fee if necessary in the subsequent suit. Considering the submissions made by counsel for the plaintiff, the plaintiff is allowed to withdraw the suit.

Accordingly, CS-COM/572/2024 is dismissed as withdrawn. The Department is directed to return the Court-fee to the plaintiff with liberty to re-use the said Court-fee in the subsequent suit if the plaintiff desires to file. (KRISHNA RAO, J.) s.pal
