1. The petitioner/plaintiff has filed the present contempt application on the allegation of wilful, deliberate, contumacious violation and noncompliance of the order passed by this Court dated 30th August, 2024 wherein this Court has directed the defendants/contemnors to secure an amount of Rs. 40,07,102/- by keeping the said amount in separate account till 4th October, 2024.

Counsel for the petitioner/plaintiff submits that in terms of the order dated 16th April, 2025 passed in the contempt application, the contemnor has filed affidavit along with the xerox copy of fixed deposit under Reinvestment Plan receipt no. 728 in connection with account no. 001201400003685 dated 11th February, 2025 of the

District Co-Operative Bank Limited, Head Office-Varanasi for a total sum of Rs. 15,00,000/- and the maturity date is 11th February, 2026 and the maturity amount is Rs. 16,09,369/-.

The contemnor has also submitted a demand draft in the name of the Registrar, Original Side of this Court being demand draft no. 404021 dated 9th April, 2025 for an amount of Rs. 12,00,000/- of Punjab National Bank, Varanasi Branch, Uttar Pradesh. Subsequently, the alleged contemnor has further submitted another demand draft being no. 404027 dated 20th May, 2025 for a sum of Rs. 13,00,000/- drawn on Punjab National Bank, Varanasi-Sigra (Varanasi Branch), Uttar Pradesh before the Registrar, Original Side of this Court. As per the report of the Registrar, Original Side, this Court found that an amount of Rs. 12,00,000/- deposited by the alleged contemnor is invested in the fixed deposit of Indian Bank, being DDR no. 0086998 on 2nd May, 2025 and the maturity date is 6th June, 2026.

The amount of Rs. 13,00,000/- deposited by the contemnor is invested by the Registrar in the fixed deposit receipt no. 885154 of Central Bank of India dated 5th July, 2025 and the maturity date is 6th July, 2026 and the alleged contemnor has also deposited the fixed deposit under the re-investment plan receipt of District Co-Operative Bank Ltd. for an amount of Rs. 15,00,000/- and the maturity amount is Rs. 16,09,369/- and the maturity date is 11th February, 2026.

5. As the defendant has deposited the total amount of Rs. 40,00,000/-. Thus, this Court did not find any reason to keep the present contempt application pending.
