... for the defendant The Court: The matter is listed as "To Be Mentioned" on the prayer of the learned counsel for the respective parties on the ground that the parties have settled their disputes and have entered into a terms of settlement and when the matter is called today learned counsel for the respective parties have filed the terms of settlement entered between the parties on 4th October, 2024 wherein it reveals that the plaintiff and the defendant have signed the terms of settlement. It is found from the record that the plaintiff has filed the suit praying for decree for a sum of Rs.1,03,74,184/- along with interest at the rate of 24% and other reliefs but during the pendency of the suit, the parties have settled their dispute wherein the defendant is ready to pay the
full and final settlement amount of Rs.50,00,000/-. As per the terms of settlement, the first installment of Rs.20,00,000/- has been paid and the remaining amount Rs.30,00,000/- will be paid in terms of the settlement. Heard learned counsel for the respective parties. Perused the terms of settlement.
This Court finds that there is no impediment to accept the terms of settlement entered between the parties.
Accordingly, CS-COM/270/2024 (Old No. CS/102/2021) is disposed of in terms of the settlement entered between the parties on 4th October, 2024.
Decree be drawn accordingly by making the terms of settlement dated 4th October, 2024 as part of the decree. Consequently, the interlocutory application being GA/1/2021 is disposed of.
