The Court:- This is an application for extension of the mandate of the Arbitral Tribunal, which expired on January 15, 2025. The petitioner prays for extension of the mandate. The jurisdiction of this court is invoked on the ground that the seat of arbitration is at Kolkata as per the agreement and the Arbitral Tribunal had also granted liberty to the claimant, proceed before this Court for further extension. The parties submit that the proceeding is near conclusion and final arguments are to commence soon. Considering the substantial progress made in the arbitral proceeding, this Court is of the view that that ends of justice demand that the mandate of the Arbitral Tribunal must be extended. Accordingly, the mandate is extended by a further period of eight months from the date of communication of this order.

The Court has not gone into the merits of the issues involved. All rights available to the parties are kept open. As no affidavit in opposition has been called for, the objections which are available to the respondent under law, may be raised at the appropriate stage.

AP-COM/225/2025 is disposed of.
