The Court:- This is an application for grant of letters of administration with the authenticated copy of the last Will and Testament dated 2nd March, 2015 and Codicil dated 23rd June, 2020 left behind by the above-named deceased.
The deceased had left behind a Will dated 2nd March, 2015 and Codicil dated 23rd June, 2020, the probate of which has been obtained from the High Court of Justice England and Wales, Principal Registry of the Family Division, HMCTS Probate. The executor of the said Will and under the Codicil is James Leslie Needley. Since it is not possible for the said executor to come over to India and apply for the grant, the said executor after obtaining the probate has appointed Mrs. Sharmistha Ghosh as his lawful attorney to obtain letters of administration to the estate left behind by the above named deceased in India. The said Attorney has applied for grant of letters of administration under Section 241 of the Indian Succession Act, 1925. The Letters of
Administration is sought for with a copy of the probate so obtained in England restricted to two bank accounts and an immovable property outside the Ordinary Original Civil Jurisdiction of this Court but within the State of West Bengal. The application for Letters of Administration, therefore, is maintainable before this Court in exercise of the concurrent jurisdiction of this Court available under Section 300 of the Indian Succession Act, 1925. In the aforesaid facts and circumstances, the Letters of Administration as prayed for in terms of prayer (a) of this application is granted to the attorney (applicant) subject to the attorney furnishing a personal bond for a sum of Rs.28,50,000/- with two sureties. The grant of letters of administration is made in accordance with the provisions of Section 241 of the Indian Succession Act, 1925.
The petition for grant of letters of administration stands disposed of, accordingly.
