...for the KMC The Court : 1. The petitioner seeks to challenge the inaction on the part of the Municipal authorities in failing to take a decision on the proposed building plan submitted by the petitioner in respect of premises No.23A/660, Diamond Harbour Road, Ward No.81, Kolkata-700053. 2.

According to the petitioner, although the petitioner had taken all steps and although the portal of the respondents would show that the consolidated demand raised has already been paid and there has been substantial progress, the final outcome thereof has not been intimated to the petitioner.

When the matter came up for consideration on 30th March, 2026, this Court noting the case made out had directed the learned Advocate representing the respondents to take instruction in the matter. 4.

Ms. Quraishi, learned Advocate representing the Municipality today, has placed before this Court a report dated 17th April, 2026, which records that the proposal submitted by the petitioner has been rejected on the ground of mismatch with the deeds and records. Let a copy of the report filed in Court today be taken on record.

There has been no official communication of rejection of the proposal to the petitioner nor was any opportunity given to the petitioner to remedy the defects. 6.

Having regard to the peculiar facts, I direct the concerned Executive Engineer to provide the petitioner with the reasons for rejection, if any, and if any remedial steps can be undertaken by the petitioner, to give opportunity to the petitioner to take such remedial steps.

It is expected that the above communication shall be issued by the Executive Engineer within a period of 7(seven) working days from the date of communication of this order.
