The Court :- This is an application for grant of letters of administration to the estate left behind by the above named deceased without the Will annexed.
The parents of the deceased predeceased him. The widow is the petitioner and the daughters have consented to the grant of letters of administration.
It is submitted by the petitioner that the ad valorem court fee required to be paid for obtaining the letters of administration was not available at the time of filing of the application. The Court fee has now been obtained. The petitioner is willing to deposit the Court fee in the Department. The Department, however, could not accept the same as the petitioner had made a prayer for postponement of payment of the Court fee in the application for grant of letters of administration. Now that the Court fee is available with the
petitioner, let such Court fee be submitted with the Department for effecting the grant.
Considering the view of the department upon complete scrutiny, the letters of administration to the estate left behind by Naba Kishore Saha the deceased above named is granted to his widow, Mala Saha, in terms of prayer (a) of the petition subject to the petitioner furnishing a personal bond for a sum of Rs.2,10,000/- with one surety.
The petition for grant of letters of administration stands disposed of, accordingly.
