The Court : On behalf of the petitioner it is submitted that after perusing the report filed on behalf of the West Bengal Transport Corporation (in short 'WBTC') the petitioner has noticed certain discrepancies in respect of the computation provided by WBTC in their report. Although the arrears have been released on the basis of the basic pay and other emoluments which are receivable by the petitioner as per the computation of WBTC but the computation being erroneous, the entire benefit of Career Advancement Scheme (in short CAS) has not been given to the petitioner. The petitioner had approached this Court for non-receipt of CAS benefits. After the arrears have been paid, the grievance of the petitioner that he was not given the CAS benefits do not subsist any more. The petitioner is now entitled to claim

further amounts on the basis of his computation since the computation made by WBTC, according to the petitioner, is erroneous. The petitioner therefore does not want to press the present writ petition any further but seeks leave to file a fresh writ petition on the changed scenario that the computation made by WBTC for providing CAS benefits to the petitioner is incorrect and the petitioner is entitled to further amount towards the same if correctly computed. The submission that the computation of WBTC is erroneous or incorrect is disputed by WBTC. In the aforesaid facts and circumstances, the instant writ petition is disposed of without any further order but granting liberty to the petitioner to assail the computation provided by WBTC through a report in form of an affidavit, if permissible in law.
