The Court :- Testator died issueless. His wife pre-deceased him. His only brother being elder to him also pre-deceased him. The son of the elder brother is the executor as also the sole beneficiary under the Will . Considering the view of the department upon complete scrutiny, the application for grant of probate is allowed by granting order in terms of prayer (a) of the petition.
