The Court: Counsel for the plaintiff and the counsel for the defendant nos. 1, 2, 3, 6, 7 and 8 are present. None appears on behalf of the defendant nos. 4 and 5. Counsel for the plaintiff submits that the defendants have forwarded a letter through e-mail dated 14th July, 2022 which reads as follows : "With reference to the captioned matter, this is to inform you to kindly communicate to the Hon'ble Court, Mrs. Hoori Kripalani and parties mentioned in the letter/legal notice dated 25th August, 2020 our regret at the words used in this communication.

We also withdraw the suggestive allegations made at the children of Late Mr. Sunil I Jagtiani namely Simran Jagtiani Banerjee and Sahil Jagtiani Banerjee in the said letter.

In addition to the above, please also communicate that we shall stake no claim over the properties whether movable or immovable mentioned in the aforesaid letter/legal notice or on the Estate of Late Mr. Sunil I Jagtiani, and waive all rights to the same, if any for now and at all times in perpetuity.

We hope for a cordial familial relationship with Mrs. Hoori Kripalani." It is further submitted that on the basis of the letter dated 14th July, 2022, the plaintiff do not intend to proceed with the matter and prays for withdrawal of the suit on the basis of the communications made between the respective parties.

In view of the communications, submitted by the respective parties, CS/89/2020 is dismissed as withdrawn.

The connected application being GA/1/2020 also stands disposed of.
