1. Complaining inaction on the part of the municipal authorities in failing to arrest the illegal construction in premises nos.52 and 53, Narkeldanga North Road, PS- Narkeldanga, Ward-29, Borough- III, Kolkata- 700011, the present writ petition has been filed.

2. Mr. Ghosh, learned Advocate appearing on behalf of the municipality by placing before this Court a report dated 1st April, 2026 duly counter-signed by the Executive Engineer (C), Building, Borough - III submits that a G+3 storied residential building has been sanctioned vide B.P. No.2025030071 dated 8th November, 2025 at premises no.53, Narkeldanga North Road. According to such report, no unauthorized construction has been detected at the abovementioned premises though the construction is still going on. In so far as premises no.52, Narkeldanga North Road is concerned, there is also no unauthorized construction detected thereat.

3. Let a copy of the aforesaid report as placed before this Court be taken on record.

4. Having heard the learned Advocates appearing for the respective parties, I am of the view that no fruitful purpose would be served in keeping the writ petition pending.

5. Accordingly, the writ petition is disposed of by directing the municipality to keep a vigil and ensure that the construction that is coming up at premises no.52, Narkeldanga North Road is in accordance with the sanctioned plan. (RAJA BASU CHOWDHURY, J.) akg/
