The Court: The above Sections 34 and 36 applications have been filed by the award debtor challenging the award passed on 31st December, 2018. This Court by an earlier order in the execution petition filed by the award holder in EC/462/2022 has already declared the award to be a nullity and on consent of parties appointed an Arbitrator.

In light of the same, the Section 34 application being AP 102 of 2023 is allowed. GA/1/2023 has become infructuous and is accordingly disposed of. Parties are directed to continue with their arbitration as per order dated 20th March, 2023.
