The petitioner has preferred the present petition under Section 11(6) of the Arbitration and Conciliation Act, 1996 seeking appointment of a Sole Arbitrator to adjudicate the disputes between the parties arising out of an Agreement dated 27.01.2025 containing an arbitration clause 64.(1) of the Indian Railways Standard General Conditions of Contract. Without getting into the merits of the matter learned counsel for the parties states that they do not dispute the existence of the agreement and the arbitration clause contained in the agreement. Learned counsel for the parties, with the consent of the parties submits that a Sole Arbitrator shall be appointed to adjudicate the

disputes between the parties in terms of the arbitration clause contained in the agreement.

Learned counsel for the parties mutually proposed the appointment of Mr. Aniruddha Mitra, Senior Advocate, High Court at Calcutta as the sole Arbitrator to adjudicate the disputes between the parties.

In view of the prayer made by the counsel for the parties, and with their consent this Court appoints Mr. Aniruddha Mitra, Senior Advocate, High Court at Calcutta (Mob: 9831205865) as the Sole Arbitrator to adjudicate the disputes between the parties.

The learned Sole Arbitrator shall enter upon the reference after duly complying with Section 12 of the Arbitration and Conciliation Act. The learned Sole Arbitrator shall be entitled to fix his remuneration in terms of the Fourth Schedule of the said Act. All questions relating to arbitrbility of the dispute, admissibility of the claims, limitation and other issues are kept open to be urged before this learned Sole Arbitrator.

A copy of this order shall be communicated to the learned Sole Arbitrator to take necessary steps.

With the aforesaid directions, the present petition stands disposed of.
