The revenue has filed the present appeal against the order dated 18th March, 2016 passed by the Income Tax Appellate Tribunal "A" Bench Kolkata in I.T.A. No. 841/Kol/2013 and C. O. No.54/Kol/2013 for the assessment year 2009-10.

Learned counsel for the appellant has produced a letter which has been conveyed by the office of Principal Commissioner of Income Tax-2, Kolkata dated 15th May, 2019 specifying therein the C.B.D.T's circular

no.03/2018 dated 11.07.2018 which, according to the learned counsel for the appellant, is applicable to this case and in view of that circular, he may be permitted to withdraw the present appeal.

The present appeal is disposed of, however, keeping open the question of law raised therein.
