The Court: Affidavit-in-opposition and affidavit-in-reply filed today be kept on record.

Learned Counsel for the alleged contemnor also files a compliance report indicating that, during pendency of the contempt application, the order of this Court has been complied with. A copy thereof is handed over to his counterpart appearing for the petitioner. Learned Counsel for the petitioner submits that the alleged contemnor only made an endeavour to comply with the order after the filing of the contempt application. That apart, learned Counsel controverts the stand taken by learned Counsel for the alleged contemnor inasmuch as the facts and legal arguments are concerned.

Be that as it may, since contempt is an extreme measure and is generally not used unless there is a serious and deliberate violation of the order of the Court, in view of compliance of the order of this Court by the alleged contemnor, albeit during pendency of the contempt application, no useful purpose will be served in keeping the contempt application pending. Accordingly, CC/27/2020 is disposed of as infructuous. No order as to costs.
