The Court : In the absence of any document being produced to substantiate the original claim made by the petitioner to the respondent-insurance company, this application is not maintainable. According to the respondent, they have already allowed the claim of the petitioner to the tune of Rs.37,98,145/-. However, as prayed for by Mr. Ghosh, leave is granted to the petitioner to withdraw this application with liberty to file a fresh application disclosing the original claim lodged by it to the respondent-insurance company.
