Although the petitioner is not represented at the time of call, however, I find that by an order dated 24th September, 2020, the coordinate Bench of this Court had directed to issue rule and the rule was made returnable on 3rd November, 2020. Record would also reveal that the Deputy Sheriff had certified that the engrossed order of the rule dated 24th September, 2020 was duly served upon the PA to the alleged contemnor no.1.

Since then when the matter was taken up on 12th September, 2025 as it was not clear whether the alleged contemnor no.1 had appeared pursuant to the aforesaid rule, this Court directed the department to ascertain whether the contemnor no.1 had caused appearance pursuant to the aforesaid rule before the learned Registrar, and to file a report in this regard. This Court also directed service of notice on the alleged contemnors intimating that this contempt application shall be taken up for consideration on 7th November, 2025. 3.
Although, from the office report dated 3rd January, 2026, it would transpire that the department had taken steps to cause the aforesaid order be served on the alleged contemnors, however, the envelopes which were forwarded to the
contemnors have returned with the endorsements of the special messenger all dated 16th October, 2025 wherefrom it appears that the letters have not been received by the said contemnors as they do not hold the said posts at present. 4.
Though the contemnors had refused service and though they claim that presently they do not hold the relevant posts, in my view the above does not absolve them from the contempt proceeding. However, taking into consideration the fact that the petitioner chose not to be represented after 24th September, 2020, I am of the view that the matter need not be proceeded further. 5.
Accordingly contempt application stands dismissed, 6.
Rule stands discharged.
