The Court: This is an application for condonation of delay in filing of the review application being RVWO 10 of 2021. I have heard Mr. Chatterjee appearing on behalf of the applicant and I am satisfied that

sufficient ground existed for the said delay. Accordingly the application being GA 1 of 2021 for condonation of delay is allowed. Upon consent of both parties the review application being GA No. 2/2021 is taken up. I have perused the memorandum of review and I am satisfied with the grounds therein. Mr. Chatterjee submits that his client Mr. Abrarul Haque is present Mutwalli of the said Estate, M. Safiulla Wakf Estate. Mr. Chatterjee submits at the relevant time when the order was passed by me, his client was not aware of the demise of the writ petitioner no. 1, Sadrunnessa Quraishy. He accordingly prays that the writ petitioner no. 1 name be deleted. In my view, the application may be allowed and accordingly the name of Sadrunnessa Quraishy is deleted as petitioner no. 1.

The petitioners are directed to provide a fresh amended copy of the writ petition to the Department and thereafter the Department is directed to carry out the changes. The petitioners should file the corrected amended copy of the writ petition within seven days and the Department is directed to carry out the changes within two weeks thereafter. With the above observations, the application being GA 2 of 2021 stands disposed of.

Memorandum of review being RVWO 10 of 2021 also disposed of accordingly.

The Department is directed to act on server copy of the order.

Urgent photostat certified copy of this order, if applied for, be made available to the parties, subject to compliance with all requisite formalities.
