The parties have agreed for appointment of a sole Arbitrator. Mr. Arnab Chakraborty, counsel appearing on behalf of the respondent has relied on page 51 of the petition to indicate Arbitrators that are empanelled with the respondent company and has submitted that any one of the names may be chosen as the Arbitrator.

However, upon going through the list it appears that none of these persons are based in Kolkata and therefore, it could be highly inconvenent to appoint any of these persons.

In light of the above, Mr. Jayjit Ganguly, Advocate (Mobile No. 9830052031) is appointed as Arbitrator to resolve the disputes between the parties.

The appointment is subject to submission of declaration by the Arbitrator in terms of Section 12(1) in the form prescribed in the Sixth Schedule of the Act before the Registrar, Original Side of this Court within four weeks from today.

Let this order be conveyed to the Arbitrator by the Registrar, Original side forthwith.

Since no affidavits have been used by the parties, the allegations contained in the petition are deemed to be denied. AP No. 54 of 2022 is, accordingly, disposed of. (SHEKHAR B. SARAF, J.) RS
