The Court :- Affidavit-of-service filed in Court be kept with the record. The writ petitioner is aggrieved by the in-action on the part of the Superintendent of Police, Berhampore in giving assistance to comply with the order of the District Magistrate, Murshidabad dated 9th August, 2018 issued under Section 14 of the SARFAESI Act, 2002.

Having heard learned Counsel for the petitioner and the State, this Court directs the Superintendent of Police, Berhampore to render all assistance to the writ petitioner/ State Bank of India in taking physical possession of the secured asset in compliance with the order of the District Magistrate, Murshidabad in memo no. 1303(05)/ RM dated 9th August, 2018.

The costs to be incurred for the police assistance shall be communicated to the petitioner bank by the Superintendent of Police, Berhampore, within seven days of this order.

It is expected that the process of taking possession and handing over secured asset to the petitioner bank is completed within a month from date. (RAJASEKHAR MANTHA, J.) mg/K Banerjee
