The present appeal has been filed impugning the order No.FO/77775/2017 dated November 9, 2017 passed by the Customs Excise and Service Tax Appellate Tribunal, EZB, Kolkata in Excise Appeal No.E/76107 of 2017.

Learned counsel for the appellant submitted that the appellant wishes to withdraw the present appeal for settlement of dispute under Sabka Vishwas (Legacy Dispute Resolution) Act, 2019.

As the assessee wishes to withdraw the present appeal for settlement of dispute under Sabka Vishwas (Legacy Dispute Resolution) Act, 2019, the present appeal is dismissed as withdrawn, however, leaving the substantial questions of law open.
