The Court : It is rightly pointed out by learned counsel for the respondent that no copy of the arbitration agreement in question has been annexed at all to the present application under Section of the Arbitration and Conciliation Act, 1996.

In such view of the matter, AP No.115 of 2023 is dismissed on the ground of non-maintainability, with liberty to the petitioner to file afresh with a certified copy and/or original of the arbitration agreement.
