...For the Petitioner The Court : This application is for amendment of the affidavit of assets connected with the probate application being PLA No.92 of 2018 on the applicant being made aware of a certain fixed deposit in the Indian Overseas Bank. The applicant is the executor and sole beneficiary of the Will and Testament dated 9th September, 2015 of the deceased one Nimai Lal Dhar. The documents in relation to the fixed deposit have been annexed to the application and have been described in paragraph-2 of the application. Upon perusing the document this Court is of the view that GA No.1 of 2021 may be allowed in terms of the prayer therein. The probate petition and the affidavit of assets shall be amended by adding the portions underlined in the manner as indicated in the copy of the application containing the proposed amendments.

The Department is directed to carry out the amendments within two weeks from the date on which the Court reopens in November, 2021.

The petitioner is given liberty to re-verify and re-affirm of the probate petition and the affidavit of assets respectively. GA No.1 of 2021 is allowed and disposed of in terms of the above. (MOUSHUMI BHATTACHARYA, J.) S.De/mg
