The Court: The petitioner has approached this Court by way of the present application under Section 11(6) of the Arbitration and Conciliation Act, 1996, for appointment of an arbitrator for resolution of disputes and differences that have arisen between the parties hereto.

From the supplementary affidavit filed in Court today and the annexures thereto, I see that the parties have since agreed upon the personnel of the arbitrator Justice Jyotirmay Bhattacharya (Retired), a former Chief Justice of our Court, has been agreed upon by the parties as the sole Arbitrator.

In that view of the matter, I need not pass any further order on this application.

Since I have not called for any affidavit, the allegations contained in the petition are deemed not to be admitted by the respondent. AP No.278 of 2020 is accordingly disposed of. (ARIJIT BANERJEE, J. ) kc
