...For the private respondent The Court: Report has been filed by the engineers of Borough - IX, KMC signed on 24th April, 2024. It appears therefrom that the proceeding under Section 400(1) KMC Act, 1980 is pending consideration before the Special Officer (Building) for hearing. The person responsible for making unauthorised construction has been directed to deposit certain sum for proceeding under Section 400(1).

As the petitioner has raised objection with regard to the subject construction, accordingly, the Special Officer is directed to grant an opportunity of hearing to the petitioner at the time of consideration of the proceeding under Section 400(1) of the Act.

Steps shall be taken in the matter at the earliest. The writ petition stands disposed of.
