...for the respondent The Court: The present petition has been filed under Section 11 of the Arbitration and Conciliation Act seeking appointment of an Arbitrator by invoking the arbitration clause contained in agreements dated 23.09.1999 and 17.03.2004 as well as the lease deeds dated 30.08.2000 and 16.09.2004.

Learned Counsels for the parties do not dispute the existence of the arbitration clause and mutually agree to the appointment of an Arbitrator to adjudicate the disputes between the parties. The parties have suggested the name of Hon'ble Retired Chief Justice Jyotirmay Bhattacharya. In view of the same, this Court appoints Hon'ble Retired Chief Justice Jyotirmay Bhattacharya as the learned sole Arbitrator to adjudicate the disputes between the parties.

The learned sole Arbitrator will be at liberty to fix his remuneration in accordance with law.

The learned sole Arbitrator shall, prior to entering upon the reference, make the necessary disclosure in terms of Section 12 of the Arbitration and Conciliation Act.

All questions relating to arbitrability of the dispute, admissibility of the claims, limitation and other issues are kept open to be urged before the learned sole Arbitrator.

A copy of this order shall be communicated to the learned sole Arbitrator for taking necessary steps.

With the aforesaid directions, the present application stands disposed of.

Since no affidavits have been called for, none of the contentions are deemed to be admitted.
