This is an application for recording termination of the mandate of the learned Arbitrator and for appointment of a substitute arbitrator. The parties are ad-idem that a substitute arbitrator is required to be appointed in view of the elevation of the erstwhile learned Arbitrator as an Hon'ble Judge of this court.

Under such circumstances, the application is disposed of by appointing Mr. Partha Pratim Roy, learned Senior Advocate, as the learned substitute Arbitrator. The parties will be at liberty to pray for return of the files, pleadings and documents from the erstwhile learned Arbitrator. The proceeding shall continue from the stage it was last held before the erstwhile learned Arbitrator. The appointment is subject to a declaration from the learned Arbitrator under section 12 of the Arbitration and Conciliation Act, 1996. The Arbitrator shall fix his remuneration in accordance with the provision of the Arbitration and Conciliation Act, 1996 Act read with Schedule IV thereof. In view of the elevation of the erstwhile learned Arbitrator, this application is allowed and disposed of accordingly. (SHAMPA SARKAR, J.) pkd/JM
