The Court: The petitioner had preferred the present writ petition being aggrieved by the inaction of the respondent Corporation in not taking any action against the unauthorized construction in the form of a multi storied building at premises No. 16/1B, Nandalal Bose Lane (presently renumbered as premises no. B/16/1B/H/2, Nandalal Bose Lane), Kolkata.

Learned senior Counsel for the petitioner Mr. Saptansu Basu contends that the private respondents have carried out illegal and unauthorized construction on the abovementioned premises in the form of a multi storied building. He further submits the petitioner has made several representations before the respondent Kolkata Municipal Corporation seeking appropriate action, but the same have not been acted upon.

Learned Counsel for the Respondent states that the corporation is ready and willing to decide the petitioner's representation dated 5th February, 2025. Learned senior Counsel states that he shall be satisfied if the same is decided within a time bound manner.

In view of the statement made by the Counsel for the parties, this Court directs the respondent no. 6 to decide the petitioner's representation dated 5th February, 2025 strictly in accordance with law, within a period of 6 weeks from the date of communication of this order after affording an opportunity of personal hearing to the petitioner as well as the private respondents or any other stakeholder by way of speaking order.
