The Court: After considering the Clause 11 of the memorandum of understanding dated October 14, 2015 I find that this Court lacks the jurisdiction to entertain the relief claimed by the petitioner in this application. Accordingly, as prayed for by the petitioner, leave is granted to the petitioner to withdraw this application with liberty to file a fresh application before the Competent Court at Alipore. If the petitioner files such application within October 16, 2020, it is expected that the same shall be taken up by the concerned Court before October 20, 2020.
