The Court : Mr. Mukherjee appears on behalf of the respondent and submits that this application is not maintainable because the disputes are not arbitrable. Moreover, the agreement entered into between the parties is fabricated and forged. In fact, a First Information Report being ECO Park Case No. 223 of 2020 has already been filed before the Appropriate Police Authorities and the investigating authorities are at an advance stage of the investigation. In any event, it is submitted that this Court has no territorial jurisdiction to entertain this petition.

None appears on behalf of the petitioner nor is any accommodation prayed for on their behalf. The matter has been adjourned on an earlier occasion, i.e., on 7 February, 2022 when the petitioner was not represented and even prior thereto the petitioner had taken diverse adjournments. It appears that the petitioner is not interested in proceeding with this application. AP 302 of 2021 stands dismissed for default.
